Anni Dewani's Murder: Husband To Be Extradited To South Africa For Trial by Benson Agoha

Shrien Dewani should be extradited to South Africa to face trial as soon as possible, the High Court ruled today.

In a land mark rulling, the court led by the The Lord Chief Justice of England and Wales, Lord Thomas of Cwmgiedd decided that, in the interest of Justice and that of Anni's family, there should be no further delay in going ahead with the trial.

The three-man panel included Mr Justice Ouseley and Mr Justice Blake.

In a post-ruling interview with campaigner `Justice4Anni, the late brides uncle Ashok Hindocha, thanked the British judiciary for the decision which has now taken them a step closer towards learning what happened to their relative.

Thanking all who have supported them in their fight for justice, he told Shrien Dewani, "..if you want justice for Anni, Vinod Hindocha will come with you to South Africa."

Today's High Court decision, was not without its conditions. For example, among others, it said..

The Court in South Africa will still go ahead and conduct the trial if the accused arrives there but was found to be unfit to stand trial.

And "in the event of the appellant being found unfit to be tried, he will be free to return to the UK, unless there is found to be a realistic prospect of his being tried within a year (or other stated reasonable period) of that finding and the trial takes place within the period."

It said "In any event the appellant must be free to return in the event a Court in South Africa, having found him unfit to be tried, embarked on the process of determining under the Criminal Procedure Act 1977 whether he did the act."

The court concluded saying "..in the interests of justice, including the interests of her family who like other families of murdered persons wish to see a trial take place as soon as is practicable, require expedition and that there should be no further delay, provided that proper protection is afforded to the appellant in the manner we have set out."

After the ruling `Justice4Anni' which has been vigorously campaigning for the accused to be extradited, tweeted "..expected to be extradited between 15th and 23rd February 2014 to South Africa, where he is wanted to stand trial for Ann's murder."
