But after spending 6 days in jail, the judge ordered her release on a new condition, which includes that she will not withhold marriage licences and will not stop her colleagues from issuing them to gay couples.
According to the CNN, her release from jail from reminiscent of the reception according former US President John Kennedy as hundreds of supporters came to cheers her up.
On Tuesday, the judge ordered her release but barred her from withholding marriage licences from gay couples.
Outside the Carter Detention Centre, she cried on seeing the massive supporters cheering her on after her release and told them: "I just want to give God the glory." adding "His people have rallied and you are a strong people."
She said "We serve a living God who knows exactly where each and every one of us is at. Just keep on pressing. Don't let down, because he is here. He's worthy."
Her husband, who has been her strong supporter over the issue, acknowledge cheers from the crowd, while his wife Kim, who said issuing the licenses would violate her conscience and go against her religion, plans to return to work in Rowan County, Kentucky this week and won't resign from her post.
But since the U.S. District Judge David Bunning, who ordered her released attached conditions, it is left to be seen if she will accept those conditions, or whether her employers will reassign her.
While she was in jail, her deputies gave marriage licenses to same-sex couples in her absence.
Asked by a reporter whether her stay in jail was worth it, Davis smiled and nodded, but said nothing more on the issue.
In a two-page order, Bunning ordered the U.S. Marshals Service to release her on the condition that she shall not “interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples.
Kim Davies who was elected has asked for her name to be removed from the Certificates if they are to be issued to same-sex couples. On her release, she repeated the request and it is left to be seen if that will be granted.
A rally is planned during which she will be speaking on the issue, her lawyers say, but most important they praised her for being true to her belief. She became born again four years ago.
Kim Davis was jailed because her refusal reportedly contradicted the US Supreme court's decision that because `love is love', every American should be free to marry whomever he/she desires.
